If you're moving abroad, applying for a spouse visa, or registering your marriage in a foreign country, your Indian marriage certificate needs to be legally authenticated for international use. Apostille vs Attestation: The Key Difference
The choice between apostille and attestation depends entirely on whether the destination country is a member of the Hague Convention of 1961:
- Apostille (Hague countries): A single, standardised certification issued by the MEA. Once apostilled, the document is accepted in all 120+ Hague member countries — no further embassy step needed. Faster and simpler.
- Attestation (non-Hague countries): A multi-step chain of authentication: State Home Department attestation → MEA attestation → Embassy/Consulate attestation of the destination country. Required for countries like the UAE, Saudi Arabia, Qatar, Kuwait, and Oman.
Hague Convention Countries (Apostille Applies)
India became a member of the Hague Apostille Convention in 2005. Over 120 countries now accept an Indian apostille, including:
- United States, United Kingdom, Germany, France, Netherlands, Spain, Italy
- Australia, New Zealand, South Africa
- Most EU member states
- Brazil, Argentina, Mexico, Turkey, and many more
For these countries, you do not need to visit the embassy. The MEA apostille stamp is sufficient.
Non-Hague Countries (Full Attestation Required)
Major destinations that require full embassy attestation include the Gulf countries and a few others:
- United Arab Emirates (UAE), Saudi Arabia, Qatar, Kuwait, Oman, Bahrain
- China, Egypt, Malaysia (varies by document type)

The Apostille Process: Step by Step
- Obtain the original marriage certificate from the registrar. It must be the original or a notarised true copy — photocopies alone are not accepted.
- State-level attestation: The certificate must first be attested by the Home Department or General Administration Department (GAD) of the state that issued it. For West Bengal certificates, this is done through the State Home Department in Kolkata.
- MEA apostille: Submit the state-attested certificate to the Ministry of External Affairs (MEA), either at the MEA Counter in New Delhi or through authorised outsourced service providers. The MEA verifies the state attestation and places the apostille sticker on the certificate.
- Collection: The apostilled certificate is returned, typically within 5–15 working days total.
The apostille sticker contains a unique reference number, the country of issue (India), the date, and the official MEA seal. It is internationally verifiable through the Hague Conference's online e-Register.
The Attestation Process (Non-Hague Countries)
- State Home Department attestation (as above).
- MEA attestation: The MEA attests the state-authenticated certificate (a stamp, not the apostille sticker).
- Embassy attestation: The certificate is submitted to the embassy or consulate of the destination country in India (e.g., UAE Embassy in New Delhi), which places its own attestation after verifying the MEA stamp.
- MOFA (where required): For some Gulf countries, a final Ministry of Foreign Affairs attestation is done after arrival in the destination country.
